How to set a probation period fair to both sides

How a probation period actually works in practice, how long to make it, and why a probation that lapses in silence costs you the decision.

The clause nobody has ever used

Your appointment letter says six months probation because the template you downloaded said six months probation. You have never ended anyone's employment during it. You have never written a confirmation letter at the end of one. For every person who has joined the business the clause has simply expired without comment.

That is the normal position and it is worth fixing. A probation period is not paperwork. It is a scheduled decision point and it is the only one most small businesses ever build into a hire. Wasting it means carrying every hiring misjudgement at full cost for years.

What probation does not give you and what it costs

Probation does not hand you a free right to terminate. What you can do and on what notice is set by the appointment letter and by the employment law that applies to your establishment and your state. People assume probation suspends all of that. It does not. If you are relying on the word to give you flexibility you have not read your own letter.

The cost of a long probation is paid in candidate quality rather than in money. A strong candidate holding two offers reads a six-month probation with withheld benefits as a signal about how the business treats people. You will lose some of those candidates and you will not know which ones. Where confirmation is tied to a pay increment the delay is a real cost to the employee and they price it accordingly.

Who should shorten it and who should drop it

If you are hiring senior or scarce talent then a long probation is working against you. A head of sales with fifteen years behind them and a competing offer will treat a six-month qualifying period as an insult or as a risk. Shorten it to three months or remove it and rely on a notice period instead. The signal you lose is worth less than the candidates you lose.

If you will not actually review at the midpoint then do not set a probation at all. An unused clause is worse than no clause because it creates an expectation of a review that never happens and it gives your team evidence that written commitments here are decorative. Businesses that cannot commit a manager to two short reviews per hire should accept that and manage on notice terms alone.

How to set one that does something

Match the length to one complete delivery cycle in the actual role. A content writer produces a month of work in a month so ninety days is ample. A field salesperson with a four-month sales cycle cannot be fairly assessed in ninety days. The question is not what is customary. It is how long until you can see real output.

Write the criteria into the letter in two or three lines. What the person must be doing independently by the end of it. Vague criteria mean you cannot fail a probation without it looking arbitrary and so you never will. Then diarise two conversations. One at the midpoint where a correction is still possible. One in the final fortnight where the decision is made.

Finish it with a written outcome either way. A confirmation letter when it goes well. A documented extension with reasons and a new date when it does not. An extension can be reasonable once. Twice is you avoiding the decision.

How to judge whether your probation works

The metric that matters is the share of probations that end in a written decision rather than lapsing in silence. If that number is zero then the clause is doing nothing. A second check is whether anyone has ever actually not been confirmed. A process with a hundred per cent pass rate is not a filter.

The metric that flatters is the length of the period. Owners feel protected by six months and that feeling is unrelated to whether the protection exists or is ever used. Length without a review date is theatre.

The common mistake

The usual error is silent lapse. Nobody diarises the end date so the probation passes and the person is confirmed by default. You have then spent the only structured opportunity to reverse a hiring decision without using it. The cost arrives later as a long and awkward management problem that everyone could see at month two.

The other version is treating probation as a substitute for managing. A person who is told nothing for three months and then told they have not been confirmed has been failed by the business rather than the reverse. Probation without feedback is not a test. It is a trap and the team watching will read it exactly that way.

The rules that govern probation confirmation and notice in India come from a combination of central labour legislation and the shops and establishments act of the state you operate in, along with any standing orders that apply to your category of establishment. Because that mix differs by state and by headcount there is no single correct clause and online templates routinely carry provisions that do not apply to you. A qualified professional should confirm what your appointment letter can and cannot say for your situation before you issue it to the next joiner.
