When can I cancel my GST registration?

You can apply for cancellation if your business has been discontinued, transferred, merged or converted into another entity, if there is a change in constitution that requires a new PAN, or if you are no longer liable to be registered. The GST officer can also cancel a registration on their own, for example when returns have not been filed for a prolonged period.

Do I need to file pending returns before cancelling GST?

It is advisable to file all pending returns and pay any dues before applying. The officer reviews your compliance history and outstanding returns usually lead to queries or delays. Late fees and interest continue to apply on returns that remain unfiled, so clearing them early keeps the cancellation process simpler and the final cost lower.

What is the final return after GST cancellation?

After your registration is cancelled you must file a final return in Form GSTR-10. It is due within three months of the date of cancellation or the date of the cancellation order, whichever is later. The return captures details of stock held on the date of cancellation and any tax payable on it. Missing it can attract late fees and notices.

Do I have to pay tax on stock when cancelling GST?

Yes, in most cases. When a registration is cancelled, you must pay an amount equal to the input tax credit on inputs held in stock, semi-finished and finished goods, and capital goods on the date of cancellation, or the output tax on them, whichever is higher. The exact calculation depends on your records and is worked out during the process.

What if the GST department has started cancellation against me?

If you receive a show cause notice proposing cancellation, you should reply within the time given, usually by filing pending returns and explaining your position. If the registration has already been cancelled, a revocation application may be possible within the prescribed time.
