Who needs a PAN?

A PAN is needed by anyone who earns taxable income, files an income tax return, runs a business or profession with turnover above the prescribed limit, or carries out specified transactions such as opening a bank account, buying property above certain values or investing in securities. Companies, LLPs, firms, trusts and other entities also need their own PAN.

Who must file an income tax return?

You must file a return if your total income before certain deductions exceeds the basic exemption limit. Filing is also required in some other cases, such as holding foreign assets, making large cash deposits or incurring high foreign travel or electricity spending. Companies, LLPs and partnership firms must file every year, even if they had a loss or no income.

Who needs to apply for a TAN?

Any person who is required to deduct tax at source or collect tax at source must obtain a TAN. This includes companies, LLPs, firms, trusts and individuals or proprietors who are liable to deduct tax on payments such as salary, rent, professional fees, commission or contract payments. Certain individuals deducting tax only on specific transactions may be exempt.

Who needs to file TDS returns?

Any person who has a TAN and has deducted tax at source during a quarter must file a TDS statement for that quarter. This includes employers deducting tax on salaries and businesses deducting tax on rent, professional fees, commission, interest, contract payments and payments to non-residents. Separate statements are filed for different categories of payments.
