What should I do first if my insurance claim is rejected?
Start by asking the insurer for the reasons in writing and reading the policy wording relied on. Then file a written grievance with the insurer's grievance redressal officer, attaching your documents. Insurers must acknowledge and respond within the timelines set by the regulator. Keeping a copy of every letter helps if you later approach the Ombudsman or a consumer commission.
When can I approach the Insurance Ombudsman?
You can usually approach the Insurance Ombudsman if the insurer rejects your grievance, does not reply within 30 days or gives a reply you are not satisfied with. The complaint should generally be filed within one year of the insurer's reply. The Ombudsman handles claims up to a monetary limit set in the rules, and the service is free for policyholders.
Can I go to a consumer commission instead?
Yes. A policyholder can file a complaint before a consumer commission for deficiency in service by the insurer. Which commission hears the case depends on the value of the claim. The consumer route can take longer and may involve a filing fee, but it suits some cases better. You generally cannot pursue the same dispute in two forums at once.
Is a favourable outcome guaranteed?
No. The insurer, the Ombudsman or the consumer commission decides each case on its own facts, the policy terms and the evidence.
