What is the difference between a provisional and a complete specification?

A provisional specification describes the invention in general terms and secures an early filing date while you continue development. It does not need claims. A complete specification fully describes the invention, sets out the claims and is what the Patent Office examines. If you file a provisional application, the complete specification must follow within twelve months or the application is treated as abandoned.

Why should I do a prior-art search before filing?

A prior-art search looks for earlier patents, publications and products that may already disclose your idea. It helps you judge whether the invention is likely to be considered new and inventive. It also helps the patent agent draft claims that steer clear of existing work. A search reduces the risk of spending on an application that is unlikely to succeed, but it cannot guarantee grant.

What cannot be patented in India?

The Patents Act excludes several categories. These include mere discoveries, abstract theories, methods of agriculture, methods of medical treatment, traditional knowledge, and computer programs as such. Some new forms of known substances are also excluded unless they show improved efficacy. A patent agent can advise whether your invention falls into an excluded category and how it might be framed.

How long does a patent last?

A granted patent in India is valid for twenty years from the date of filing the application. Renewal fees must be paid periodically to keep it in force. If the fees are not paid, the patent lapses. After the term ends, the invention enters the public domain and anyone can use it.

Can I talk about my invention before filing a patent?

Avoid disclosing your invention publicly before filing. Publishing it, presenting it at an event or selling a product that reveals how it works can count as prior art against your own application. If you must share details with investors or manufacturers, use a non-disclosure agreement. Filing a provisional application first is a common way to protect your position.
