Who needs to apply for a TAN?
Any person who is required to deduct tax at source or collect tax at source must obtain a TAN. This includes companies, LLPs, firms, trusts and individuals or proprietors who are liable to deduct tax on payments such as salary, rent, professional fees, commission or contract payments. Certain individuals deducting tax only on specific transactions may be exempt.
Is a TAN different from a PAN?
Yes. A PAN identifies a taxpayer for income tax purposes, while a TAN identifies a person who deducts or collects tax at source. A business needs both. The TAN must be quoted in TDS and TCS challans, quarterly statements and certificates, while the PAN is used for filing your own income tax return.
What happens if I deduct TDS without a TAN?
You cannot deposit tax deducted or file TDS statements correctly without a TAN. Failure to apply for a TAN when required, or not quoting it in prescribed documents, can attract a penalty under the income tax law. Banks may also refuse to accept TDS challans without a valid TAN, so it should be obtained before the first deduction.
Do I need a separate TAN for each branch?
A single TAN can be used for all deductions made by a business. However, where branches or divisions deduct tax and file statements independently, each may obtain a separate TAN.
