Who can apply for trademark registration in India?

Any individual, proprietorship, partnership firm, LLP, company, trust or society that uses or intends to use a mark can apply. The mark does not have to be in use already. You can file on a 'proposed to be used' basis and still get protection from the application date. Individuals, startups and registered small enterprises pay a lower government fee.

When can I use the ™ and ® symbols?

You can use the ™ symbol once your application has been filed. It signals that you claim the mark as your own. The ® symbol can be used only after the trademark is actually registered. Using ® on an unregistered mark is treated as falsely representing a mark as registered and can attract penalties, so it is worth waiting until the registration certificate is issued.

How long is a registered trademark valid?

A registered trademark is valid for ten years from the date of application, not from the date of registration. It can be renewed for further periods of ten years each, with no limit on the number of renewals. Renewal should be filed before expiry. If it lapses there is a short window to renew with an extra fee and a limited option to restore it.

Why should I do a trademark search before filing?

A search shows whether an identical or similar mark is already registered or pending in the same or related classes. Filing a mark that clashes with an earlier one often leads to an objection or an opposition, which adds cost and delay. A search lets you change or adjust the name before you invest in it. It reduces risk but cannot guarantee acceptance.

What is a trademark class and how many do I need?

India follows the international Nice Classification, which groups goods and services into 45 classes. Your trademark protects you only in the classes you register. A clothing brand would usually file in the class for clothing, while a software company might need classes for software and for IT services. A separate government fee applies for each class, so it helps to choose carefully.
