A registered trademark protects your brand for ten years from the application date. To keep that protection you need to renew it. If the registration expires and is not renewed, the mark can be removed from the register and your exclusive rights end. Someone else could then apply for the same or a similar name. Renewal is simple when done on time, and it is far cheaper than trying to win a brand back later.

When should I file for trademark renewal?

You can file a renewal application in the year before your registration expires. Most owners file a few months ahead so there is no risk of missing the date. The ten-year term is counted from the application date, so check that date rather than the date on the registration certificate. Vibence can confirm the exact due date from the official record.

What happens if my trademark registration expires?

If you miss the expiry date, the law allows a short period to renew with an additional surcharge. If that window also passes, the mark may be removed from the register. In some cases an application for restoration can be made within a limited time, but it is not automatic. Once removed, others may be able to file for the same mark.

How much does trademark renewal cost?

The Vibence professional fee for renewal is ₹1999 for individuals, proprietorships, registered MSMEs and recognised startups. The government renewal fee is extra and is charged per class. It is lower for individuals, startups and small enterprises than for other applicants. A higher fee applies if you renew after expiry. GST applies to the professional fee.

Can I change the goods or services when I renew?

No. Renewal continues the existing registration for the same goods or services. You cannot add new items or new classes through a renewal application. If your business has grown into new products or services, you will need a fresh trademark application for them. You can, however, choose not to renew some classes if you no longer need them.

How long does a renewed trademark stay valid?

Each renewal extends the registration for a further ten years from the date the previous term expires. There is no limit on how many times a trademark can be renewed, so a brand can stay protected indefinitely as long as each renewal is filed on time. It is sensible to diarise the next due date as soon as the renewal is complete.
