TDS Return Filing: FAQs

Who needs to file TDS returns?

Any person who has a TAN and has deducted tax at source during a quarter must file a TDS statement for that quarter. This includes employers deducting tax on salaries and businesses deducting tax on rent, professional fees, commission, interest, contract payments and payments to non-residents. Separate statements are filed for different categories of payments.

What are the due dates for quarterly TDS returns?

Quarterly TDS statements are generally due by 31 July, 31 October and 31 January for the first three quarters of the financial year, and by 31 May for the last quarter. The government can extend these dates. Tax deducted must be deposited separately, usually by the 7th of the following month, with a different date for March.

What is the penalty for late filing of TDS returns?

A late fee applies for each day of delay in filing a TDS statement, capped at the amount of tax deducted. Separately, a penalty may be levied if the statement is not filed within a year or contains incorrect information. Interest also applies on late deduction or late deposit of tax. Filing on time is the simplest way to avoid these costs.

What are Form 16 and Form 16A?

Form 16 is the TDS certificate an employer issues to employees for tax deducted from salary, usually once a year. Form 16A is issued quarterly for tax deducted on other payments. Both are generated from TRACES after the quarterly statement is processed. Deductees use them to claim credit for the tax deducted when filing their own returns.

Can a filed TDS return be corrected?

Yes. If a TDS statement has errors such as a wrong PAN, an incorrect amount or a missing challan, a correction statement can be filed after the original is processed. Corrections are prepared using the consolidated file downloaded from TRACES. Timely corrections help deductees get proper credit and can resolve default notices raised on your TAN.
